Seller Shipping Terms and Conditions

Thank you for choosing WatchGuys! Below are the terms and conditions for shipping your watch to WatchGuys. At Cooltimepieces LLC dba WatchGuys (hereinafter referred to as "CTP LLC," "us," or "we"), we strive to ensure a secure, seamless, and satisfactory experience for all our valued customers. By mailing your watch to WatchGuys, you agree to the following terms and conditions, which are designed to safeguard your valuable items and ensure a smooth transaction process. Please read these terms carefully, as they form a binding agreement between you and CTP LLC.

1. Free Shipping Labels

CTP LLC is proud to provide complimentary FedEx shipping labels to all sellers sending items to our designated office. These labels are specifically designed to ensure the safety, security, and expedience of your shipment. By utilizing our shipping label, you help us streamline the process and minimize any potential risks associated with the transit of valuable items.

Important Details:

  • The FedEx shipping labels provided by CTP LLC are exclusively for use with the specific item(s) agreed upon during the transaction process. They cannot be used for personal shipments or for items unrelated to the current sale.
  • Each shipping label is linked to the transaction and should not be shared or duplicated for unauthorized purposes.
  • To obtain a shipping label, sellers must provide complete and accurate details about the item, including but not limited to its brand, model, condition, and any accompanying accessories.
  • If the shipping label is not used as intended or for its designated purpose, the seller assumes all risks, including potential denial of liability or insurance coverage.

2. Insurance Coverage

At CTP LLC, we prioritize the security and protection of your valuable items. While we provide insured shipping labels for added peace of mind, it is important to note that CTP LLC is not an insurance company. We arrange insurance coverage through our own insurance policy, which applies exclusively to CTP LLC as the insured party.

Key Points About Insurance:

  • Insurance coverage is facilitated through CTP LLC’s internal policies and is strictly limited to shipments made using the FedEx shipping label we provide.
  • The insurance coverage is based on the accurate description of the item provided by the seller before shipping. Any discrepancies or misrepresentations regarding the item’s value, condition, or authenticity will void the coverage.
  • Only CTP LLC is covered under the insurance policy. In the event of loss or damage during transit, CTP LLC will handle the claims process directly with our insurance provider on your behalf.
  • Sellers will not be involved in the insurance claims process but will be informed about the status and resolution of the claim.
  • Coverage is strictly limited to the agreed-upon value established during the evaluation process. If a higher value is later claimed without prior agreement, CTP LLC reserves the right to deny coverage.
  • Items that are not shipped using the provided FedEx shipping label or that fail to comply with the outlined packaging guidelines are not eligible for protection under CTP LLC’s insurance policy.

Resolution Process:

  • If an issue arises during shipping, such as loss or damage, CTP LLC will work directly with our insurance provider to address the issue and ensure a fair resolution.
  • Sellers are not required to file claims independently, as this is managed entirely by CTP LLC under our insurance policy.
  • Please note that CTP LLC’s insurance is intended to cover financial loss directly associated with the shipped item and does not extend to indirect or consequential damages.

3. Packaging Guidelines

Proper packaging is a critical component of ensuring the safety of your item during transit. CTP LLC requires sellers to adhere to strict packaging standards to minimize the risk of damage or tampering. Failure to comply with these guidelines will result in denial of liability or insurance coverage.

Packaging Requirements:

  • Use a NEW FedEx box that is free from prior markings, labels, or damages that could compromise the shipment’s integrity.
  • Double-boxing is strongly recommended for all shipments. Place the watch in its original box or a similarly secure container, and then package this inner box inside a larger, reinforced shipping box.
  • Use ample cushioning materials, such as bubble wrap, foam, or packing peanuts, to prevent movement of the item inside the box. Ensure that the item is fully protected on all sides.
  • Seal the box securely with strong packing tape, ensuring that all seams are properly reinforced to prevent accidental opening during transit.
  • Affix the provided FedEx shipping label to the outermost box. Ensure that the label is clearly visible and properly secured.
  • Do not include unrelated items or personal shipments in the package. CTP LLC is not responsible for items outside the agreed-upon transaction.
  • It is strongly recommended to take photo's or video while packaging your item(s).

4. Authorization to Sell

CTP LLC only purchases watches and jewelry from individuals who have full ownership rights to the item(s) being sold. By using our services, you warrant and represent that:

  • You are the legal owner of the item(s) being sold, or you have the full legal authority to sell the item(s) on behalf of the rightful owner.
  • You have the full and unrestricted decision-making authority to sell the item(s) to CTP LLC.
  • The item(s) being sold are authentic and free from any claims, liens, or encumbrances.

If you are not the rightful owner of the item(s) or do not have the legal authority to sell, or if the item(s) are not authentic, do not use our services. Providing fraudulent or misrepresented items is strictly prohibited and may result in legal action.

5. Quoted Price

The price quoted to you by CTP LLC is an estimate based on the information you provided during your submission, phone call, or email. By using our service, you acknowledge and agree that the quoted price is subject to change upon inspection of the item(s) at our facility. The final price offered will reflect the actual condition and attributes of the item(s) received. Factors That May Affect the Price:

Description: If the item is described inaccurately or incompletely, the quoted price may need to be adjusted.

Condition: Items requiring additional care or restoration, such as:

  • Polishing: The item requires professional cleaning or refinishing to restore its appearance.
  • Crystal Replacement: The crystal is scratched, cracked, or otherwise damaged and needs replacement.
  • Missing Links: The watch’s bracelet is incomplete or missing links.
  • Bracelet Replacement: The strap or bracelet (leather, rubber, or metal) is damaged or requires replacement.
  • Servicing: The watch requires maintenance or servicing to ensure proper functionality.
  • Movement Damage: The internal mechanism is damaged and requires replacement parts.
  • Rust or Corrosion: Evidence of rust or corrosion that impacts the item’s value.
  • Aftermarket Parts: The watch contains non-original or aftermarket parts that need to be replaced to restore authenticity.

Other conditions or factors not listed here may also affect the quoted price. CTP LLC reserves the right to make appropriate deductions to the final offer based on these conditions. Furthermore, if the item is not in a condition that meets our quality standards, CTP LLC reserves the right to decline the item altogether. In such cases, the item will be returned to you at no additional cost.

If the condition of your item significantly differs from the description provided, CTP LLC will notify you of the revised price. No transaction will be completed without your approval.

6. Tracking and Confirmation

To ensure the secure delivery of your package, sellers are encouraged to closely monitor their shipment from the moment it is sent until it is successfully received and confirmed by CTP LLC. The tracking process is a vital step in safeguarding your item and ensuring a smooth transaction.

Seller Responsibilities:

  • Retain all shipping and tracking information provided by FedEx. This documentation serves as proof of shipment and is essential for resolving any disputes or issues.
  • Monitor the shipment’s progress using the FedEx tracking system. Notify CTP LLC immediately if there are any irregularities or delays.
  • Ensure that the package is delivered to the correct address provided by CTP LLC. Any deviations or errors may compromise the transaction.

7. Exceptions and Limitations

While CTP LLC strives to provide a seamless and secure shipping experience, certain limitations and exclusions apply to our insurance and liability policies. It is important for sellers to understand these exceptions to avoid potential misunderstandings.

Insurance Exceptions:

  • Insurance coverage is limited to shipments made using the FedEx shipping label provided by CTP LLC. Alternate shipping methods are not eligible for coverage.
  • Items that are unrelated to the agreed-upon transaction, such as additional watches, jewelry, or other valuables, are excluded from the insurance policy.

Ineligible Items:

  • Personal items or shipments made for purposes other than selling to CTP LLC are not covered under this agreement.
  • Items shipped without prior approval or those that deviate from the agreed-upon description may be excluded from coverage and liability.

9. Agreement to Terms

By utilizing the shipping services provided by CTP LLC, you acknowledge and agree to these terms and conditions. This agreement represents the full understanding between you and CTP LLC regarding the seller shipping process. Any disputes or deviations from these terms must be addressed in writing and approved by CTP LLC.

 

SECTION 1: Terms for Customers Shipping Watches to WatchGuys (Inbound Shipments)

1. Use of Complimentary FedEx Shipping Labels

CTP LLC offers complimentary FedEx shipping labels to approved sellers for the purpose of sending agreed-upon items to our facility. These labels:

  • Are valid only for the specific transaction initiated with CTP LLC.

  • Must not be reused, altered, duplicated, or applied to unauthorized items.

  • Are void if misused, and such misuse will nullify any insurance or liability coverage.

2. Insurance Coverage for Inbound Shipments

CTP LLC insures inbound shipments under its own third-party policy. You acknowledge:

  • Only CTP LLC is the insured party; you, the sender, are not the policyholder.

  • Coverage is valid only if you use the provided FedEx label and adhere to all packaging guidelines.

  • If any false, incomplete, or misleading information is provided (including misrepresented value, authenticity, or condition), coverage is automatically void.

  • The maximum insurable value is limited to the agreed-upon valuation prior to shipment.

CTP LLC will manage all claims with the insurer. You will be notified of the resolution, but you will not participate in the claims process.

3. Required Packaging Standards

To qualify for insurance and to limit liability, you must:

  • Use a new, unmarked FedEx box.

  • Securely double-box the item, placing the watch inside a protective case within a reinforced outer box.

  • Use protective materials (bubble wrap, foam, etc.) to prevent internal movement.

  • Clearly attach the FedEx shipping label provided by CTP LLC.

  • Photograph or video the packaging process to document the condition and compliance.

Non-compliance voids coverage.

4. Ownership, Authority & Authenticity Declaration

By sending a watch to CTP LLC, you warrant:

  • You are the sole legal owner or have full legal authority to sell the item.

  • The item is authentic and not subject to liens or claims.

  • Misrepresentation or sale of counterfeit items will result in legal action, and full refund of any amounts paid to you.

5. Pricing and Offer Adjustment

Quoted prices are based on your initial submission and are subject to change upon in-person evaluation. Deductions may be applied due to:

  • Inaccurate descriptions

  • Cosmetic or mechanical damage

  • Missing parts or accessories

  • Non-authentic or aftermarket components

You will be notified before any final offer is made. No payment will be issued without your approval.

6. Tracking, Delivery & Time Limits

You are responsible for tracking the shipment until it is received by CTP LLC. Any claims related to missing or delayed packages must be submitted within 30 calendar days from the shipment date.


SECTION 2: Terms for Customers Receiving Purchases from WatchGuys (Outbound Shipments)

1. Insurance Coverage & Delivery

CTP LLC insures outbound shipments via designated carriers. Insurance coverage:

  • Commences once the package is picked up by the carrier.

  • Ends upon delivery confirmation via signature or 14 days from shipment, whichever is earlier.

  • Applies only if the delivery requires an adult signature.

  • Will be voided if the recipient:

    • Chooses “no signature” delivery.

    • Provides permission to leave the package unattended.

    • Allows redelivery to another address not authorized by CTP LLC.

Maximum coverage is based on the actual purchase value unless otherwise stated in writing.

2. Delivery Inspection Requirement

You or your authorized recipient must inspect the shipment in the presence of the carrier. If there are signs of:

  • Tampering

  • Damage

  • Open or re-sealed packaging

  • Missing contents

You must refuse delivery and require the carrier to document the issue in writing. If you accept delivery of a compromised shipment, you waive all rights to file a claim or request reimbursement.

CTP LLC is not liable for losses related to shipments marked as delivered with a valid carrier signature.

3. Claim Reporting

Any shipment issues must be reported in writing to CTP LLC at sales@watchguys.com within:

  • 30 days of the shipment date

  • 45 days if the package was refused and returned

Failure to report within these timeframes bars any insurance claims or resolution eligibility.


SECTION 3: General Terms for All Shipments

1. Limitation of Liability

Unless a higher value is expressly declared and confirmed in writing by CTP LLC:

  • Our maximum liability is limited to $100 per shipment.

  • CTP LLC is not liable for indirect damages, including but not limited to loss of value, market fluctuation, inconvenience, or loss of business.

2. Time-Bar for Claims

All legal claims or demands—whether related to insurance, breach of agreement, or other issues—must be initiated in writing within one (1) year from the shipment date. After this time, all claims are irrevocably time-barred.

3. Binding Arbitration Clause

You agree that any and all disputes with CTP LLC shall be resolved exclusively through binding arbitration in Los Angeles, California, under the Commercial Rules of the American Arbitration Association.

  • Arbitration shall be conducted before a panel of three arbitrators, each with professional experience in transportation and insurance law.

  • No class actions, mass arbitration, or representative claims are permitted.

  • Each party shall bear its own costs, and the arbitrators’ decision shall be final and binding.

4. Excluded Risks and Non-Covered Events

The following are not covered under any circumstance:

  • Shipment tampering accepted without documented exception at delivery

  • Fraudulent redirection or release based on impersonation

  • Losses due to incorrect or insufficient packaging

  • Unauthorized shipment methods

  • Shipments not reported to CTP LLC on the same day as tendered to carrier

  • Cyber events, war, or government seizures

  • C.O.D. amounts or payments

By using CTP LLC’s shipping services, whether to send in a watch for sale or to receive a purchased item, you affirmatively agree to all terms and conditions contained herein. These terms are binding, enforceable, and may be updated by CTP LLC without prior notice.
